Really interesting overview. Trump's lack of a filter will continue to be his biggest liability with the courts. He leaves quite the digital trail on his personal social media site and in conversations with media, making it difficult to claim he was misunderstand in his comments about Musk and DOGE.

I do think presidents of all political persuasions need to take care with these appointees that do not receive Congressional review/vote. It sets a precedent with possibility serious consequences.

And Musk's lack of understanding/arrogance about the real work of the federal government is wrecking havoc. His latest act of incompetence -- firing workers at the USDA tasked with combating H5N1 -- follows firing nuclear weapons workers in a decision that puts communities at real risk. THAT needs the attention of the media. Stat.

I agree ….I certainly trusted Obama more than Trump, but nevertheless we need to take a good long look at appointments without congressional approval but more importantly who we approve to the Supreme Court. So far, Trump can do no wrong

Agree 100% about Obama AND that his arrogance was problematic. He signed way too many executive orders as well. Easier to pick up a Sharpie than work with Congress, but it ends up with a worrisome consolidation of power.

Hi Gabe. Enlightening as always. Does anyone know how many Musk minions are attached to DOGE? What are their qualifications? How are they paid and how much? Are they paid by the government or by Musk? Where are they based? Is there any publicly available info about these vandals?

Hi, Gabe. Are you able to do a countdown (periodically) to when Elon Musk's temporary staff position ends? I believe you mentioned he can work for 130 days annually. Thanks!

Hi Gabe. Did any of the Czars appointed by Obama, not confirmed by congress make any policy or decisions that were destructive, unconstitutional or debated in the media ?

Hi Barbara, thanks for writing. “Destructive” is subjective, of course, so I won’t weigh in there -- I’m sure some would say yes and others would say no, depending on their party affiliation. But the czars were most certainly debated at length in the media and their constitutionality was questioned by legal scholars (examples: https://doi.org/10.1080/07343469.2011.642057, https://heinonline.org/HOL/LandingPage?handle=hein.journals/jlp26&div=6&id=&page=, https://markrozell.gmu.edu/wp-content/uploads/2011/11/Sollenberger_and_Rozell_Debating_the_Presidency_Chapter_2014.pdf, https://www.wsj.com/articles/SB10001424052748703574604574499953992328762) and by lawmakers, including Democratic senators (https://archive.nytimes.com/www.nytimes.com/gwire/2009/02/25/25greenwire-byrd-questions-obamas-use-of-policy-czars-9865.html)

My recollection is that Obama resorted to EOs and appointments because he was unable to get anything done through Congress.

Thanks. Pro and Con. :) I asked as I don’t recall near the angst about czars appointed by Obama as the anger about Musk.

New Mexico is one of the states that is party to the suit challenging Musk’s authority. No coincidence that the NM U.S. Attorney bringing the suit has now been fired. Is he the only one dealt with in this way or are there others?

Just like in the years after Roosevelt had been elected for four terms, I strongly suspect that after 2028 there will be some constitutional amendment to limit EOs or Czars or whatnots. And then I wonder if the amendment passed will subsequently affect the favoring party like the Presidential term limits amendment historically did. Great article today Gabe! What a douchebag Musk is! I love that they can't even do basic math on their Website.
